Delgado was speeding at the time, but since the boy was cycling alone at night without reflectors or a helmet, the driver wasn't charged with anything other than being a complete jerk. Under public pressure, he later dropped his lawsuit.

Of course, since he didn't have $5 million to pay himself, he asked that the state pay on his behalf. His suit was thrown out.
